If you have become pregnant as a result of non-consensual sexual intercourse (e.g., sexual assault or rape, regulated in Sections 176-178 of the Criminal Code), you have the right to terminate the pregnancy.
Legal requirements
- The criminological indication for this can be made by any physician in accordance with Section 218a (3) of the Criminal Code.
- This indication may not be issued by the same doctor who performs the termination.
- The termination can be performed up to the 12th week of pregnancy after fertilization (14th week of pregnancy after the last menstrual period).
- There is no obligation to seek prior counseling. However, you have the right to counseling, e.g., at pro familia and all other state-approved pregnancy counseling centers: Pregnancy counseling in Munich
- The procedure may only be performed by a physician with the consent of the pregnant woman.
Cost coverage
- Statutory health insurance companies cover the costs of the abortion, including medical treatment and any necessary follow-up care.
- An application for cost coverage is not required.
- With private health insurance companies, you may have to apply for cost coverage.
